76 Arkansas schools are breaking state law by using a banned punishment on students. The Arkansas legislature approved Act 1329 in 2013 banning out of school suspension as a punishment for students who have missed school.

The Education Commissioner Johnny Key remarked on the absurdity of kicking truant students out of school in a statement: “You have kids that are truant and your discipline for them is to kick them out of school. There’s laughter because it is absurd when you think about it.”

Both Little Rock School District and Pulaski School District which are under state control have been found to be using the banned punishment.

Act 1329 however does not specify any consequences for school districts which still choose to use the punishment.
