UALR Law Professor Robert Steinbuch joins Conduit News to explain the lawsuit against the LEARNS Act. Steinbuch says the lawsuit is not one based on the merits of the law, but rather about how the emergency clause was passed.
Steinbuch says when dealing with constitutional interpretation whereby the possibility of striking a law exists, there are several things to consider.
“To be fair, I don’t think that the whole argument is ridiculous,” Steinbuch says. “But, I think the better argument is had by the Governor. Moreover, in the end, what’s going to happen if they strike the emergency clause? Well, then they still have the law. The law passed.”
